Updates to Epinium’s Terms of Service & Privacy Policy

Whether you are one of our freemium users or one of our largest customers, we deeply value the trust you gave us by using Epinium and want to say “thank you” for it.

The latest changes to our Terms of Service and Privacy Policy demonstrate both our commitment to maintaining your trust and our dedication towards a product that always puts your privacy and your data, and the privacy and data of your users, first. Below is a summary of the changes made in April 2018 to both of these documents.

Terms of Service

  • Added the General Data Protection Regulation (GDPR) into the applicable laws governing the terms
  • Added the definition of Personal Data and incorporated it into the terms in order to denote our commitment to protecting it
  • Added information and a link to how users can sign a Data Processing Agreement (DPA) with us if they desire or are required to do so by law
  • Added greater clarity that we require our users/customers to use our service in accordance with the laws they are regulated by
  • Updated the right of assignment and delegation so that our users/customers can transfer their Epinium account to a new owner in connection with a consolidation, merger, acquisition or sale (subject to the laws governing their commitment to their users)
  • Tweaked previous inconsistencies related to capitalization and grammar

Privacy Policy

  • Given the Privacy Policy governs how we store and process your data, we made a significant change to its structure to position it more clearly to our intended audience (our users, customers, and visitors to epinium.com) and make it easier to read and understand
    • While well-intentioned, the previous version read as complicated and was occasionally confusing for many of our customers and users, since it addressed our privacy commitment to everyone (including our customers’ end-users). This has now been made clearer and simpler.
    • In making this change, we did not weaken our commitment to protecting the privacy and data of our customers, users, and visitors. In fact, we spelled out more clearly that any data our service captures on their behalf belongs to and is controlled by them.
  • Added a reference to Epinium’s support of Do Not Track (DNT) in addition to our Opt-Out Policy
  • Outlined your rights to your data and our commitment to safeguarding your rights
  • Added our commitment to notifying our customer and users of any security breach that affected their personal data within 72 hours of our awareness of such breach
  • Denoted the specific articles of GDPR that relate to certain processing of data for the purposes specified
  • Tweaked previous inconsistencies related to capitalization and grammar.

These changes strengthen our commitment to you and better denote that you are in control of the data captured and stored by our service based on the General Data Protection Regulation (GDPR).

What do Epinium Customers need to do?

There are two things that you might need to do depending on your situation and jurisdiction. Below are the only impactful changes that we can foresee that might affect you as a result of using Epinium:

  1. Make sure your Terms of Service or Privacy Policy properly communicate to your users how you are using Epinium (and any other similar services) on your website or app. This requirement has always been part of Epinium’s Terms of Service, but the GDPR can heavily penalize you if you’ve not done this clearly. We recommend you ensure your policies are up to date and clear to your readers.
  2. If you are in the European Union you’ll likely want to sign a Data Processing Agreement with Epinium. We’re happy to do so. Working with outside counsels in Germany and Malta we’ve updated this document to be in compliance with GDPR and other generally acceptable privacy laws.
  3. You can review and digitally sign a copy of the Data Processing Agreement here. We will countersign it and provide you with a fully executed downloadable copy via email within 2 business days. If you have any questions about its contents simply email legal@epinium.com.

Next steps:

These updates will go into effect for existing users and customers on the 24rd of May 2018 (30 calendar days from the email being sent). New users will be governed by the updated Terms of Service and Privacy Policy starting from 24rd of April 2018.
